SMITHWICK — Officials say a 9-year-old boy died Aug. 8 after the ATV he was riding flipped over on private property.
Burnet County deputies and emergency crews responded to a report of an ATV accident at 7:51 p.m. at a residence in the 14,000 block of RR 1174 South.
The boy, Cooper DeSpain, was riding the ATV by himself at the time of the accident, according to Burnet County Sheriff’s Office officials.
The youth attended Colt Elementary School and was a lifetime resident of Marble Falls. He is survived by his parents, David and Trenton DeSpain; grandparents George and Modena DeSpain, Carl and Pam Ray, and B.J. James; and his siblings, Trey McEntire, Cade DeSpain, Dillon DeSpain, Samantha McEntire and Miranda McEntire.
“Although his life was short, he will leave a lasting impact on all who were fortunate enough to get to know him,” family stated in Cooper’s obituary. “His infectious smile and witty sense of humor will long be remembered.”
A visitation and viewing is 6-8 p.m. Aug. 11 at Smithwick Church of Christ, 10804 RR 1431 East in Smithwick. His funeral is 4 p.m. Aug. 12 at First Baptist Church of Marble Falls, 501 12th St., with interment following at Smithwick Cemetery.

So so sad and sorry for this family’s loss of their loved one. To many children are killed by being able to ride these dangerous pieces of equipment. Maybe we should raise the age as to how old someone should be before being allowed to ride and have to be able to pass a safety riding test just as if one was riding a motorcycle or drive an automobile. Again so sorry for your loss..

No Compensation You understand and agree that you will receive no compensation for the submission or use of your Submitted Content.
Indemnification You agree to indemnify, defend, and hold harmless Company, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of this Agreement or any third-party claims related to your Submitted Content.
Moral Rights and Publicity You waive any moral rights or rights of attribution in the Submitted Content to the extent permitted by law. Company may use your name, username, or likeness in connection with the Submitted Content if applicable.
Termination and Removal Company may, in its sole discretion, edit, refuse to post, or remove any Submitted Content at any time without notice. This Agreement survives any termination.
Governing Law This Agreement is governed by the laws of the State of Texas, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts located in Burnet County, Texas.
Entire Agreement This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements. Modifications must be in writing. By submitting content, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
