MARBLE FALLS — A 41-year-old man was arrested after a boating accident July 4 that seriously injured a Marble Falls police captain.

James Henry “Hank” Fry of Marble Falls was charged with intoxication assault causing serious bodily injury, which is a third-degree felony.

According to a news release from the Marble Falls Police Department, Fry was driving a bass boat that struck a marked Marble Falls Police Department patrol boat and Capt. Ted Young, who was assigned boat patrol duty during the annual fireworks show on Lake Marble Falls. The incident occurred about 10 p.m.

Texas Parks and Wildlife game wardens arrested Fry.

Because a member of the Marble Falls Police Department was involved, officials contacted the Texas Parks and Wildlife Department to conduct the investigation, according to the release.

The charge can be enhanced to a second-degree felony at trial since Young was performing the duties of a peace officer when struck.

Fry was released July 5 after posting a $75,000 bond.

      Maybe that was his mistake helping the officer that caused the whole damn accident to begin with??? Just sayin.. Best wishes for Hank and his family hopefully this will get dropped before costing him an arm and a leg for nothing other than ignorance on the officers end. Who boats at night with NO LIGHTS on their boat anyways? Isn’t that illegal in itself? Was the officer issued a citation for causing this accident? I’m gonna guess here and say no and bet I’m right… Talk about crooked and 1 sided all the way…..

        Ignorance on the officer’s end? The guy was drunk. What about that don’t you get or do you just hate cops? Maybe he wouldn’t have nailed the police boat if he wasn’t trashed. Would you feel the same if one of your family members got hurt by this guy, and not this police captain?

          Yeah, such an upstanding citizen, drinking and all… Totally the victim here. Why is everyone all POOR HANK? HE is the one that was drinking!!!!!

    Doesn’t matter who drove the boats back…. accident like that can ‘jerk’ your senses back into survival mode and some ‘sense’. Don’t try and ‘whitewash’ that the driver had had to much to drink. Sad situation for all. It could have been worse.

    If the Officer had his lights off at night then his is a complete idiot. They put cops in these boats that don’t even know how to drive them. Multiple times had them check me for drinking (which I never do on the lake) and had to keep pushing their boat off mine. They’ll pull up when it’s rough, 1ft waves and only have 1 officer on board. Officer should be ticketed for not having lights on and the guy should be arrested for bwi.
